Make more stringent restrictions on caller ID spoofing.
The Issue
Caller ID spoofing has been around for years. A recent court decision supported it's legal use as long as it wasn't intended to do harm or fraud. The ability for individuals and companies to hide their identity is an injustice to the American citizens. Lawful examples that should be allowed are for all numbers of a company to display the main phone number, and for law enforcement. The argument that it is used for domestic violence victims is a poor one, they can block caller id entirely. Requiring telemarketing companies, whether it is for sales, charity, polls or political organizations, to provide a caller Id but not requiring them to accurately portray their identity is allowing organizations and companies to deceive the public. Businesses have the right to no solicitation on their premises, emails have the ability to sort spam, but the United States Citizen only has caller Id as a way of protecting themselves from unwanted phone calls. Spoofing that is done in the name of a prank, malicious joke, or any and all telemarketing should be outlawed, and the FCC/FTC should enforce these regulations. Without a valid individual or company name and address the United States Citizen is left powerless in following up complaints against individuals or companies that use this practice. For victims who have had their number and name spoofed, the lack of ability to track and punish the offending individuals and/or companies, and the lack of regulations on pursuing the offenders on the behalf of the victim needs to be rectified. Individuals and companies who have had their identity stolen in the name of "non harmful" spoofing should have a way to legally seek justice. Any company advertising the technology to spoof, whether it be land line, cell phone, internet IP address or email should be prosecuted to the full extent of the law.
