いつも私たちの活動を応援していただき、ありがとうございます。

桜丘中学校・高等学校兼務教員組合が申し立てている不当労働行為救済申立事件について、東京都労働委員会で尋問が行われます。

尋問は公開で行われ、どなたでも傍聴できます。

今回の事件では、組合員2名が65歳に達したことを理由に雇用を終了されたことが、「組合員であるが故の不利益取扱い」に当たるかが争われています。

桜丘では現在も、67歳・68歳の教員(非組合員・当組合とは別の組合の組合員)が、生徒の前で授業を続けています。

学校側は、65歳を超えて勤務している教員について、「募集をかけても人が集まらなかったため」と説明しています。

しかし、当組合員が担当していた教科についても、公募では応募がなく、派遣会社を通じて教員を確保している状況です。

それであれば、67歳や68歳の教員と同じように、長年勤務してきた当組合員の雇用を継続することもできたのではないでしょうか。

なぜ、ある教員は65歳を超えて授業を続けることができ、組合員である2名は65歳で雇用を終了されたのか。

その点が、今回の事件で問われています。

Witness Examination at the Tokyo Labor Relations Commission on October 15 — Open to the Public

Thank you for your continued support of our activities.

A witness examination will be held at the Tokyo Labor Relations Commission in the unfair labor practice case filed by the Sakuragaoka Junior and Senior High School Part-time Teachers' Union.

Petitioner: Sakuragaoka Junior and Senior High School Part-time Teachers' Union
Respondent: Sakuragaoka Educational Foundation (Gakko Hojin Sakuragaoka)

The examination is open to the public, and anyone is welcome to attend.

The issue in this case is whether ending the employment of two union members because they turned 65 was "disadvantageous treatment because of union membership."

Teachers aged 67 and 68 are still teaching students at Sakuragaoka today. They are either non-union members or members of a different union.

The school says it kept these teachers on past 65 "because no one applied when we advertised the positions."

But the subjects our members taught also drew no applicants through open recruitment, and the school is now filling those positions with teachers from a staffing agency.

If so, couldn't the school have kept our members on as well, just as it did the 67- and 68-year-old teachers? Both of them had worked at the school for many years.

Why were some teachers allowed to keep teaching past 65, while our two union members had their employment ended at 65?

That is the question at the heart of this case.
