حملة دعم المرأة العراقية : 

نبذة: بسبب معاناة المرأة العراقية في الكثير من المجالات و تعرضها للأضطهاد والتمييز في المجتمع, مما يدعو الى ضرورة خلق آليات للحد من هذا الاضطهاد والتمييز وتقع هذه الآليات على عاتق "البرلمان والحكومة ومنظمات المجتمع المدني والمجتمع نفسه" لتعزيز مكانة المرأة, وهذه الآليات: 

1. إشراك المرأة في المناصب السيادية مثل رئاسة البرلمان والحكومة والجمهورية ورئاسة مجالس المحافظات بالإضافة إلى المساواة التامة في الحياة العملية مع الرجل ودعمها للحصول على مناصب إدارية مساواةً بالرجل دون الاضطهاد والتمييز الوظيفي. 

2. تعديل المواد (41,377,409)* من قانون العقوبات بما يضمن المساواة بين الجنسين. 

3. الاسراع بتشريع قانون يحمي المرأة على غرار بعض الدول التي شرعت هذا القانون و منح المرأة المطلقة حق الولاية القانونية على أولادها و إعطاءها حرية السفر مع اولادها دون اللجوء لموافقة الأب**. 

4. الالتزام باتفاقية سيداو كاملةً والمصادقة على البروتوكول الأختياري الملحق. 

5. منح المرأة حرية الرأي والتصرف بما يتناسب ومعايير المجتمع. 

6. ألمطالبة بأنشاء مراكز اجتماعية ومراكز حماية اسرية خاصة بالمرأة. 

7. القيام بحملات توعية ودورات تثقيفية للمرأة والرجل على حقوق وواجبات المرأة حسب القوانين الدولية وتعزيز مفهوم الشراكة مع الرجل وإشراك المرأة في كافة الأنشطة الثقافية والرياضية ... الخ. 

8. إيجاد آليه لضمان حقوق المرأة مثل الميراث والتعليم في بعض المناطق في العراق. 

9. دعم الأرامل ماديا ومعنويا.

* المادة 41 عقوبات: " ﻻ ﺟﺮﻳﻤﺔ إذا وﻗﻊ اﻟﻔﻌﻞ اﺳﺘﻌﻤﺎﻻً ﻟﺤﻖ ﻣﻘﺮر ﺑﻤﻘﺘﻀﻰ اﻟﻘﺎﻧﻮن وﻳﻌﺘﺒﺮ اﺳﺘﻌﻤﺎﻻً ﻟﻠﺤﻖ: 

1 – ﺗﺄدﻳﺐ اﻟﺰوج ﻟﺰوﺟﺘﻪ وﺗﺄدﻳﺐ اﻵﺑﺎء واﻟﻤﻌﻠﻤﯿﻦ وﻣﻦ ﻓﻲ ﺣﻜﻤﮫ من اﻻوﻻد اﻟﻘﺼﺮ ﻓﻲ ﺣﺪود ﻣﺎ ھﻮ ﻣﻘﺮر ﺷﺮﻋﺎً أو ﻗﺎﻧﻮﻧﺎً أو ﻋﺮﻓﺎً". 

المادة 377 عقوبات: "1 – ﻳﻌﺎﻗﺐ ﺑﺎﻟﺤﺒﺲ اﻟﺰوﺟﺔ اﻟﺰاﻧﯿﺔ وﻣﻦ زﻧﺎ ﺑها وﻳﻔﺘﺮض ﻋﻠﻢ اﻟﺠﺎﻧﻲ ﺑﻘﯿﺎم اﻟﺰوﺟﯿﺔ ﻣﺎ ﻟﻢ ﻳﺜﺒﺖ ﻣﻦ ﺟﺎﻧﺒﻪ اﻧﻪ ﻟﻢ ﻳﻜﻦ ﻓﻲ ﻣﻘﺪوره ﺑﺤﺎل اﻟﻌﻠﻢ ﺑها. 

2 – وﻳﻌﺎﻗﺐ ﺑﺎﻟﻌﻘﻮﺑﺔ ذاﺗهﺎ اﻟﺰوج اذا زﻧﺎ ﻓﻲ ﻣﻨﺰل اﻟﺰوﺟﯿﺔ. 

المادة 409 عقوبات: " ﻳﻌﺎﻗﺐ ﺑﺎﻟﺤﺒﺲ ﻣﺪة ﻻ ﺗﺰﻳﺪ ﻋﻠﻰ ﺛﻼث ﺳﻨﻮات ﻣﻦ ﻓﺎﺟﺄ زوﺟﺘﻪ أو اﺣﺪ ﻣﺤﺎرﻣﻪ ﻓﻲ ﺣﺎﻟﺔ ﺗﻠﺒﺴها ﺑﺎﻟﺰﻧﺎ أو وﺟﻮدھﺎ ﻓﻲ ﻓﺮاش واﺣﺪ ﻣﻊ ﺷﺮﻳﻜهﺎ ﻓﻘﺘﻠهﻤﺎ ﻓﻲ اﻟﺤﺎل أو ﻗﺘﻞ اﺣﺪھﻤﺎ أو اﻋﺘﺪى ﻋﻠﯿهﻤﺎ أو ﻋﻠﻰ اﺣﺪھﻤﺎ اﻋﺘﺪاء اﻓﻀﻰ اﻟﻰ اﻟﻤﻮت أو اﻟﻰ ﻋﺎھﺔ ﻣﺴﺘﺪﻳﻤﺔ. وﻻ ﻳﺠﻮز اﺳﺘﻌﻤﺎل ﺣﻖ اﻟﺪﻓﺎع اﻟﺸﺮﻋﻲ ﺿﺪ ﻣﻦ ﻳﺴﺘﻔﯿﺪ ﻣﻦ ھﺬا اﻟﻌﺬر وﻻ ﺗﻄﺒﻖ ﺿﺪه اﺣﻜﺎم اﻟﻈﺮوف اﻟﻤﺸﺪدة. 

** من حق الازواج التعنت مع اولادهم وزوجاتهم ولاتستطيع الزوجة بالتالي اصدار اي ورقة رسمية للاولاد كالهوية او الجواز .

Iraqi woman support Campaign

 

Summary: (The Iraqi woman has been exposed to violence, injustice and distinction in many fields, and this created the necessity of creating new procedure and mechanism to stop the violence and the injustice. These procedures are the responsibility of the “Parliament, government. NGOs and the community itself to enhance the role of the woman, and the procedures as the following:

 

1- Creating real partnership within woman and sharing her in all the necessary and high performance roles and duties such as the role of the president of the country, government, and parliament and governorate councils as well as creating equalization with man for getting the same managerial roles without distinction or injustice. 

 

2- Implementing the articles (41,377,409)* of punishment law which ensures the equalization between the both genders.

 

3- Creating a law which protects the right of the divorced woman to have the royalty over her children and can travel with them without taking the permission of the fathers as it is usual in some countries.**

 

4- SEDAW agreement should adhere and approving the optional attached protocols.

 

5- Granting the woman freedom of behaving and opinion due to the community standards

 

6- Asking for creating social, parents protection centers for woman.

 

7- Providing enlighten campaigns for the both genders to display the women rights according to the International laws standards and sharing her in all the cultural and sport activities.

 

8- Finding some mechanism for guarantee the rights of learning for woman in some Iraqi areas.

 

9- Providing financial and moral supports for the women

* Article 41 sanctions: “no crime if the act happened as the use of a right was decided under the law, and is regarded the use of that right:

 

1. Spousal discipline of parents, teachers for minor children in the boundaries of what is legally decided lawfully or custom.

 

Article 41 sanctions: “1. Adulterous and perpetrator of adultery shall be punished by imprisonment, presumably aware of the offender by the marital part, unless he proves that he could not know that under any circumstances.

 

2. At the same punishment above, the husband shall be punished if he committed adultery in the marital house.”

 

Article 409 sanctions: “a person who surprised his wife, or a kin, in case of practicing adultery, or being in one bed with her partner and he kill them immediately or kills one of them or makes a severe aggression against them or one of them that this aggression made permanent disability. That person shall be punished by imprisonment of no more than 3 years. The right of legal defense cannot be used against person who makes use that of excuse and provisions of aggravating circumstances do not applied upon him.

 

** The husbands have the right of intransigence with their children and wives. In the case, the wife cannot issue any formal documents such as ID or passport for the cgildren.
