Excellent News Everyone!!!!

I received a letter from the Conservation Commission in Pepperell regarding the Denial by the Mass DEP on the Birch Drive Extension plan and wanted to share this wonderful news with everyone. This proves we can make our voices heard and things do work out for the right reasons. Thank you everyone for the support on this effort. Couldn't have done it without you all!!!!! Dear Ron As I am sure you will recall, during the last public hearing for the Birch Drive Extension project, the Conservation Commission voted to issue a Denial for the Order of Conditions for the roadway, utilities, supporting infrastructure, and stormwater. In response to this Denial, Etchstone Properties filed an appeal with MassDEP. In response to the appeal filed with MassDEP, a representative of MassDEP’s Wetlands Division visited the site with the property owner, his attorney, representatives of Etchstone Properties, and members of the Conservation Commission; conducted a review of the Denial prepared by the Commission; and completed a thorough review of the proposal. On December 19, 2017, MassDEP issued a Superseding Order of Conditions DENIAL concurring with the Commission. The Denial of the Superseding Order of Conditions by MassDEP included an opportunity for an appeal to be filed (see details in the attached). A copy of any appeal to MassDEP requires a copy also be sent to the Conservation Commission. The Conservation Commission has received nothing and the appeal period has expired. Several neighbors have asked about the status of the appeal. Would you be able to share the attached Superseding Order of Conditions Denial with your neighbors? We can only speculate as to what the owner of the property and Etchstone may be discussing, if anything at all, but if we are made aware of any updates, we will be in touch.
