Gaden House is safe for now, assuming the owner observes the law. Any works at all to the building will require council approval.
Thanks to all who took action and contacted council, the interim heritage order and now this listing were implemented in the last 2 weeks.

This email is to update you on the status of the heritage listings for “Gaden House” at 2A Cooper Street, Double Bay, specifically the local heritage listing, Interim Heritage Order and State heritage listing. We may have already updated you on some of this information.
Local heritage listing
Woollahra Local Environmental Plan 2014 (Amendment No 11) for “Gaden House” at 2A Cooper Street, Double Bay (Lots 11 and 12, DP 4606) was notified (gazetted) on Friday 6 September 2019, on the NSW Legislation website. The amendment lists “Gaden House” as local heritage item number 681, in Schedule 5 of the Woollahra LEP 2014. See the amendment here.
Interim Heritage Order
On 30 August 2019, Woollahra Council made an Interim Heritage Order (Section 25, NSW Heritage Act 1977) on “Gaden House”. Government Gazette No 98 of 30 August 2019. The Interim Heritage Order is in force for twelve months from 30 August 2019, and will remain in force irrespective of the local heritage listing.
Woollahra Council made the Interim Heritage Order because the property is considered to be of heritage significance and it was further considered that the order was necessary to protect the potential heritage item from being harmed.
The effect of the Interim Heritage Order is that a person must not carry out any works to the property, including demolition (partial or total), alterations and additions, without the approval of Woollahra Council (Section 57 and Section 59, NSW Heritage Act 1977).
State heritage listing
On 13 November 2018, Council nominated “Gaden House” for listing on the State Heritage Register (SHR). The Heritage Council of NSW considers nominations for listing on the SHR. The nomination has progressed to a point where the SHR listing committee has considered the matter. Further consideration is to occur at another meeting of the committee. We will keep you informed about the progress of the nomination.
