Statement by Michael Moulding on criminal breaches of section 106 Representation of the People's Act 1983.

Since August 2018 I have been subjected to a campaign of harassment organised and perpetrated by a small minority of individuals.

I hold evidence that the reason for their actions was to bully and harass me from not standing in this year's local elections. As part of this campaign I have been subjected to slander and defamation which I have tried to ignore.

These small minority of individuals, which have included members and activists of the local Labour Party participated in the harassment because they were afraid that if I did stand in this year's local elections they were concerned I might win.

I don't succumb to criminal bullies and harassers. I confront them head on.

Therefore, I am a candidate in this year's local elections for the Ashton ward to take place on Thursday May 2nd.

In a democratic society, elections are governed by law and under Section 106 of the Representation of the People's Act 1983 it is a criminal offence to deliberately tell lies, defame or slander a candidate with the intentions to lose that individual votes.

The law is in place to protect candidates from unlawful behaviour in what should be free and fair elections.

Three weeks ago, I wrote to the Returning Officer for the election to advise her that due to on going harassment it is likely that I would be subjected to repeated breaches of s106 RPA 1983.

I want to be clear that I am not referring to simple disagreements or opposition. I am referring to deliberate criminal acts by individuals who have no boundaries and do not care about the effects of their harassment, bullying, slander and lies.

I have received evidence that to date, two individuals who are known to me have decided to partake in vicious vitriolic abuse, lies and slander with the intentions to dupe other voters into not voting for me. 

For example, even though I have no criminal convictions, warnings or cautions to my name of any type at over 50 years of age, one of the individuals has made comments to give the impression I am a criminal when I am not. I know these two people have participated in the on going harassment.

It is with regret and after careful consideration that I have had to report these two people to GMP for clear crimes. I can confirm the acts perpetrated have been crimes and therefore, GMP have accepted they have committed crimes against me.

These criminal harassers will be dealt with.

A post is circulating that I have been responsible for closing three businesses in Ashton which is completely false and again is made up lies. This is being dealt with by GMP.

To set the record straight.

I have NO power to close any business down.

Fleece Hotel - The full story is on this thread. The lease was fraudulently obtained by the convicted criminal David McHugh from Warrington hiding in an upstairs room at the Fleece Hotel for 5 years undertaking his crimes. Under his false identity he tried to convert part of the pub into a nightclub which the community overwhelmingly opposed. The license was revoked by Wigan Council on the advise from Greater Manchester Police.

When the police were catching up with this conman he absconded from the pub, left it insecure and local youths vandalised the pub. For two years, for the benefit of our community and the owner who was ripped off, I decided to do my best to try and keep the building safe. Anymore information is freely available on this petition.

I supported the actions of Wigan Council and Greater Manchester Police to ensure that this convicted serial criminal and fraudster was no longer engaging in his crimes in our town.

Kings Arms - Admiral Taverns sold this pub and closed it themselves because it was not making any money. The new owner is in the middle of converting the property into an Asian restaurant.

Extra Food & Booze - the owner from Doncaster closed the shop because it was not supported by the local community. The owner himself alleged that he too was ripped off into buying the business paying 53,000 pounds and was not making 53 pounds a day. He was losing money so closed the shop himself.

I have the greatest admiration for the overwhelming majority of the people of Ashton. I care about this town and I am appalled at the appalling decision-making by Wigan Council that has severe detrimental consequences for residents, businesses and the well being of the town.

I am making my case and it is up to the people of Ashton whether you agree with my concerns or not.
