When is the drug driving laws going to change as its against human rights. They are taking our freedom to live and i the the right to live without being discriminated on.
I tested positive to a drug test december 2017. 2nd offence within 5 years. I smoke due to curvage to my spine which causes me great pain and smoking relieves this pain without making me a zombie like other prescription drugs that they dont test for like morphine and valium, so marijuana (a plant) allows me to work and have everyday function to spend time with my family and play with my kids.
Did we not just legalise marijuana for medical purposes? Which therefore should bring marijuana from a category 5 substance to a category 4 with other medical substances you do not test for like morphine and valium ect so how is this just and fair.
So since the last time i got done 2 years ago i read up on how long it stays in my system and the government websites variry from state.to state says to wait roughly 4-12 hours before driving as it should be out of your saliva by then and i have been waiting 20 plus hours.
I think i have a case, they can not prove or have any scientific evidence to say the drug in my system was effecting my ability to drive. They took till the 1930-1950's with intensive scientific evidence and hard work to come up with the drink driving law we still use today. I am innocent until proven guilty that is my right and every judge in Australia swore to uphold this right.
They just can not make assumptions and accusations in a court of law and thats exactly what they are doing. Zero tolerance means nothing in our legal system as thier is no evidence or grounds to to support it, the law was made up cause they are to lazy to do thier jobs correctly.
Their is not a jury that could convict me with these charges with so much reasonable doubt and speculations, specially when the police officer that charged me and suspended my license for 24 hours put me back in control off that vehicle twice. Once to move the car down the highway after getting the first positive on lick stick, and finally after i got charged and suspended from driving he put my wife on her learners in the drivers seat (L plates on) and me in the passanger seat, I am full licensed holder. So im in control off that vehicle and he deemed me safe to operate that vehicle when he put me back incontrol of it, he as police officer on duty obviously thought I was safe to operate a vehicle at the time then. So why am I going to lose my license?
I did not break any road rules, I am not DUI and my cars fully registered and roadworthy, I had a full license at the time so under what law do they have right to take my license off me. Its not what you know its what you can prove. Sorry for the rant just trying to get my head around the grossly harsh penalty i am about to recieve. I could lose my job, my house even my wife and kids all because i self medicate each night after work with marijuana to be able to live and function normally. I want to fight these allegations though i can not find any support or lawyer that is willing to stand for my rights to live free and just. What they are doing is crimnal and they are discriminating me by throwing around assumptions and allegations. What do you think?
I am fighting these allegations and could do with more support if you agree with me, stand with me. If we want it to change i can not do it alone.
