BREAKING NEWS:
“Vancouver Aquarium Uncovered” documentary film maker Gary Charbonneau found out through the media today that he is being sued by the Vancouver Aquarium!
According to CKNW Radio, “The suit alleges that film has caused damage, and that Charbonneau and Evotion are guilty of ‘reprehensible, insulting, high-handed, spiteful, malicious and oppressive conduct.’ None of the allegations have been proven, but the Vancouver Aquarium has long denied the claims made in Charbonneau’s movie. The film suggested there was cruelty and corruption at the aquarium, in particular with its program for whales and dolphins. The Vancouver Aquarium has called the movie propaganda, full of outright lies.”
However, according to Animal Justice (Canada), “the lawsuit does not allege defamation, which is a common cause of action in a case like this. In other words, Vancouver Aquarium’s lawsuit does not take issue with any of the specific claims in the documentary. Rather, they are only taking issue with the filmmaker’s use of their footage.”
So if the Aquarium is claiming that the documentary is based on lies… why then are the Aquarium lawyers not suing Gary for libel, and instead they are only going after copyright infringement?
We think that the Aquarium is hoping that by not going for a libel suit, that will mean that all the Aquarium’s dirty secrets will not be exposed when this lawsuit goes to court, because the discussion in court would focus only on copyright infringement such as Gary’s use of the Aquarium’s website info.
Well, that may be the case, but in the end all the Aquarium’s sleazy tactics will not stop the truth from coming out in the news media and social media about the cruelty of whale captivity and how the Aquarium profits from the suffering of whales and dolphins.
