Message aux signatairesURGENT: SAVE FALMOUTH'S BEAUTIFUL PENDENNIS HEADLAND FROM LUXURY FLATS
Development won't go ahead

Dear people,
We are writing to express our deep gratitude for your support to keep the Middlepoint land on Pendennis Point free from 35 luxury flats.
The appeal got dismissed today; the developer will not get permission.
We have posted the appeal decision with detailed reasons for dismissal on the Save Pendennis Point facebook group.
In short: the inspector upheld that:
-The impact by the flats on the historic setting of the headland (listed buildings: 2 castles and associated defence structures) would be too great
-The potential impact on the operation of the docks companies (in the form of complaints about noise/odour) would be too great
-Doubt that an acceptable level of smell (for a living environment) from the docks is at all achievable in that location
-The social, economic and environmental (cleaning up oil in soil around old tanks) benefits of the scheme being too poor to outweigh the harm to historical setting (the Council did not note that in their original decision)
What we take away from this is that it is possible to stand up to developers/big money. The developer claimed in their documents that South West Water had agreed to cover their sewage works. When South West Water arrived at the appeal they said they had never seen them before. The design for the access road passing through the conservation area (wooded slope) had been changed during the application process, but no additional ecological impact studies were done to assess tree loss, impact on bats etc. Another error that is amazing considering they spent a supposed 0.5 million to get this planning application through. We were lucky that this was an appeal enquiry, rather than just a hearing, which meant that the inspector basically had time to listen to many viewpoints, on topics that were not pre-agreed by Cornwall Council and the developer so we were able to bring new information at the enquiry. But if you would have told us of the errors in the developers documents some months ago we would not have believed you. Its worth the time to dig.
Thank you for your support
Warmly,
The Spiral Collective
