To date, both the developer and the City of Cape Town Authority (CoCT) were cited as respondents in our litigation proceedings against the legitimacy of building plans at St Johns Rd., Sea Point.

 

On Thursday 28th May, notice was received from the attorneys acting for CoCT, of its intention NOT to oppose our litigation but to ABIDE by the decision of the court.

One down, only one more to go..!

 

The hearing date for our expedited review is set for 11th June at the High Court of the Western Cape.

 

Given the unique nature of our case; that the Executive Mayor, in his capacity as the final appeal body, upheld our appeal against the original building plans, and produced a scathing report as to the flawed processes employed by the City's own Planning Department, we have been lobbying the DA controlled City to have them join with us as co-applicant.

 

Let's all keep the pressure on the DA controlled City Authority, which, inexplicably refused to intervene to prevent a block-style development, known to be non-compliant, from being hurriedly constructed in the midst of Sea Point's historic suburb. Instead, shifting the responsibility for enforcement of regulations back onto us, the community, to fund and bring forth legal action to protect our own neighbourhoods from the blight of over-development.
