Article 109 — Opening a Constitutional Pathway from the United Nations to an Earth Federation

GOVERNMENT OF INDIA — MINISTRY OF EXTERNAL AFFAIRS
UNGA 81 | NEW YORK | URGENT ACTION MEMORANDUM
Subject: Article 109 Initiative — Opening a Constitutional Pathway from the United Nations to an Earth Federation
For: India’s Delegation to the 81st United Nations General Assembly
Action requested before / during the General Debate, 26 September 2026
1. PURPOSE
India is requested to consider placing before the 81st UN General Assembly an urgent proposal for a General Conference under Article 109 of the UN Charter to review the Charter and examine the transformation of the United Nations into a more democratic, representative and effective system of planetary governance — an Earth Federation.
The proposal has been advanced by Chandra Vikash, Interim President of the Earth Federation, through the Article 109 Coalition representatives currently present in New York, notably Francisco Plancarte, Rita French and Tim Murithi.
2. WHY NOW
The UN was established in 1945 to save succeeding generations from the scourge of war. Eighty-one years later, the international community confronts interconnected challenges of armed conflict, genocide, nuclear danger, climate and ecological destabilisation, resource insecurity, technological disruption and widening global inequality.
The 81st UNGA itself is framed around “Restoring trust, managing transformation: A United Nations that delivers for all.”
The question before Member States is therefore not merely how to reform individual UN institutions, but whether the constitutional architecture of global governance remains adequate to the planetary challenges of the twenty-first century.
3. EXISTING CHARTER PATHWAY
Article 109 already provides a lawful mechanism for this conversation.
A General Conference to review the UN Charter may be convened by:
a two-thirds vote of the General Assembly; and
an affirmative vote of nine members of the Security Council.
Each Member State has one vote in the Conference. Any Charter alteration recommended by a two-thirds vote of the Conference subsequently requires ratification by two-thirds of UN Members, including all permanent members of the Security Council.
India is therefore invited to support initiation of the Article 109 process, without prejudging the eventual outcome of the constitutional review.
4. COMPLEMENTARY ARTICLE 97 MODEL
The ongoing selection process for the next UN Secretary-General demonstrates an increasingly transparent model of global leadership selection: Member-State nominations, CVs, vision statements and financial disclosures, followed by interactive dialogues and a public town hall.
The proposal is to extend these principles to an eventual Earth Federation transition:
Nomination → Disclosure → Public Dialogue → Global/Regional Consultation → Independent Scrutiny → Formal Selection → Constitutional Ratification
The proposed transitional leadership comprises:
1 Earth President + 2 Earth Vice-Presidents + 6 Regional Presidents + 6 Regional Vice-Presidents = 15 positions.
5. IMMEDIATE DIPLOMATIC OBJECTIVE
India is requested to:
A. Refer explicitly to Article 109 in its UNGA intervention on 26 September as a legitimate avenue for comprehensive Charter review.
B. Invite Member States to begin consultations on convening an Article 109 General Conference.
C. Build a cross-regional critical mass involving Global South countries, BRICS members and willing states from all UN regions.
D. Engage the P5 and other Security Council members on the constitutional question while recognising the Charter's prescribed procedures.
E. Encourage participation by civil society, Indigenous peoples, youth, scientific institutions, peace organisations and the Provisional World Parliament in the preparatory dialogue.
F. Explore a transition from a predominantly state-centric system toward a democratic World Parliament / Earth Federation, while protecting national, regional and local self-government through subsidiarity.
6. THE STRATEGIC VISION
The proposed Earth Federation would seek to transform global security from military deterrence toward collective human and planetary security, progressively redirecting resources presently devoted to military competition toward:
peace and conflict prevention | climate stability | ecological regeneration | food and water security | public health | sustainable development | human prosperity
The proposal envisages a constitutional order based on:
Peace • Truth • Justice • Transparency • Accountability • Sustainability • Human Rights • Ecological Security • Shared Prosperity
The objective is not to abolish the UN's achievements, but to evolve its institutions so that humanity can address problems that have become inherently planetary.
7. PROPOSED INDIAN MESSAGE
“India supports opening an Article 109 conversation: whether the United Nations, created in 1945 for a world of sovereign states, now requires a comprehensive constitutional review to meet the planetary challenges of the twenty-first century. Let us not wait for another world war or ecological catastrophe before asking whether humanity can build a more effective system of collective security, peace and planetary cooperation.”
8. REQUESTED FOLLOW-UP
India's delegation is requested to meet Francisco Plancarte, Rita French and Tim Murithi in New York to examine the proposal and supporting documentation, and to determine an appropriate diplomatic pathway for building support during UNGA 81.
Core proposition:
ARTICLE 109 CAN BE THE CONSTITUTIONAL DOORWAY TO THE NEXT STAGE OF HUMAN GOVERNANCE.
One Earth. One Family. One Future.
