One victim of the Post Office scandal is still in jail for a crime he did not commit.
Campaigners are calling on the Prime Minister, Kier Starmer and Justice Secretary Shabana Mahmood to take action and initiate an immediate review of the case and an urgent referral to the Court of Appeal
Robin Garbutt was subjected to an improper and unlawful prosecution for the murder of his wife with the main allegation for his motive being made as theft of funds from his Post Office.
He has spent 15 years in prison for a crime he did not commit.
It has been said by many that the Post Office scandal is the biggest Miscarriage of Justice in British history. Some think that the case of Robin Garbutt epitomises that injustice.
The prosecution evidence used against him is now proven to be false by the findings of the Post Office Horizon Public Inquiry. The prosecution had said he was stealing money, faked a robbery and murdered his wife to cover up his theft and used evidence from the now discredited Horizon IT system to prove their case.
In addition shocking evidence exists which shows that North Yorkshire Police either disregarded, lost or destroyed key evidence which will prove Robin Garbutts innocence, in the same way that there were improper actions by the Greater Manchester Police in the Andy Malkinson case to fit up an innocent man.
Campaigners in that case helped for the conviction to be quashed after Andy Malkinson spent 17 years in prison for a crime he did not commit. A Public Inquiry has now been set up to scrutinize the wrongdoing in the prosecution in that case and the clear improper actions of GMP which deliberately led to the conviction of an innocent man.
The extensive and compelling evidence of wrongdoing in the Robin Garbutt case should lead to the same level of scrutiny
However the CCRC have improperly and repeatedly ignored the fresh evidence in previous applications.
In the last few weeks the Justice Committee have recognised that the CCRC has not been functional or effective in its duties , with its Chair Andy Slaughter calling for urgent reform.
Robin Garbutt has suffered bereavement of close family members in the last few months , including his father.
His mother is unwell and it is a travesty that he continues to be imprisoned for a crime he did not commit while suffering such emotional circumstances.
The evidence of the Horizon Public Inquiry now proves that the prosecution evidence to convict Robin Garbutt is false.
The evidence of the Justice Committee proves that the CCRC has not functioned effectively , and therefore there are reasonable and justified grounds for the Prime Minister and Justice secretary to take action.
