My petition is to reform existing child support enforcement law. I call the it Family Financial Support Fairness Act. Under current law in the Commonwealth of Massachusetts and several other states, a noncustodial father's new wife can be held responsible for the support of her stepchildren. How so? Her income is figured into the equation when support for her husband's children by his first marriage is calculated. The needs of their mutual children are disregarded under the theory of "first family comes first." Shouldn't a man's children have equitable support and equal protection under the law, regardless of when or to whom they were born? Should a father be forced to pay for an expensive private college for his "first" children if he has medical bills not covered by insurance for a desperately ill minor child by his second wife, or should all circumstances be considered?
Nobody has ever suggested reducing a custodial mother's child support award based upon HER remarriage and counted the stepfather's income. Likewise, the income of a stepmother should be irrelevant in calculating her husband's financial obligations to his children. I am not implying in any way that a father should skip out on his duties to his children after divorce. I am only saying please make the laws reasonable and fair to children. It is not right that a father who has been honorably meeting his obligations should be punished for remarrying by being kept on a treadmill where he can never adequately support any subsequent children. The ex-wife should not have grounds to seek an upward modification of support based on his remarriage, just as he doesn't have grounds to seek a downward modification based on hers. One family should not live in luxury while the other barely gets by.
