Ban Blinding Headlights! FDA Denies Soft Lights Foundation Petition

Dear Supporters,
On December 30, 2025, the Soft Lights Foundation submitted a regulatory petition to the FDA to comply with 21 U.S.C. 360jj(a)(2) and conduct a study and provide a report to Congress on the impacts of LED lights on our health. Many of you submitted comments on the petition. (https://www.regulations.gov/document/FDA-2026-P-0028-0001/comment). Despite the mandate from Congress to the FDA to minimize emissions of and exposure to unnecessary electronic product radiation and to submit a report to Congress, the FDA denied our petition. (https://www.softlights.org/wp-content/uploads/2026/10/Response-to-Petition-FDA-2026-P-0028.pdf).
When the government officials who run the FDA have decided that protecting our health is not important to them, we all suffer.
Moving forward, we can still take the following actions:
1. The Soft Lights Foundation submitted a 1,583 page report to Health and Human Services which encapsulates a decade of advocacy and knowledge and we can hope that the FDA changes their minds. (https://www.softlights.org/wp-content/uploads/2026/10/SLF_HHS_RFI_Comment_2026.pdf).
2. NHTSA has decided to address vehicle headlamps, and we can hope that the FDA joins the effort to protect our eyes and our health from LED headlamps. (https://www.regulations.gov/document/NHTSA-2026-1981-0001).
3. Ask your Representative in Congress to hold a hearing with the FDA and demand answers as to why the FDA refuses to study the impacts of LED products on our health.
4. Contact your city officials and demand to know why they use LED flashing lights on their vehicles when NHTSA's position since 1967 is that the flashing lights create distraction, cause confusion, and make the vehicle noncompliant with federal safety regulations.
5. Receive the Freedom of Information Act documents from the FDA that show what, if any, steps the FDA has take to investigate the impacts of LED lights on our health. Soft Lights Foundation President Mark Baker has filed a FOIA lawsuit against the FDA for failing to provide these documents. (https://www.pacermonitor.com/public/case/66236075/PS_Baker_v_US_FDA)
6. Contact the media and ask them to write a story on the FDA's refusal to conduct a study on LED products such as LED headlights and LED flashing lights on emergency vehicles.
Sincerely,
Mark Baker
