
Dear Supporters,
I am preparing to file a new lawsuit for LED headlights, this time directly against the automaker Ford, based on the following statute:
49 U.S.C. 30118(c)(1) states, “A manufacturer of a motor vehicle or replacement equipment shall notify the Secretary by certified mail or electronic mail, and the owners, purchasers, and dealers of the vehicle or equipment as provided in section 30119(d) of this section, if the manufacturer learns the vehicle or equipment contains a defect and decides in good faith that the defect is related to motor vehicle safety.”
Our petition to ban blinding headlights has over 70,000 signatures and thousands of comments, indicating a large number of reports of failure of the LED headlights to perform safely, which indicates a defect in the LED headlight technology.
The statute uses the term "shall", so reporting of these defects to NHTSA by Ford is mandatory, but has not happened. A lawsuit would request a Writ of Mandate from the court to compel Ford to comply with 49 U.S.C. 30118(c)(1). A report from Ford to NHTSA that LED headlights are defective would initiate a cascade of events that would hopefully result in some action by the government.
I am researching and preparing this lawsuit now. It will be best if a professional law firm handles this case, but I will file it on my own if necessary. The primary purpose of this post is to ask if any of our supporters know of a law firm that would take this case pro bono or on contingency, or do any of our supporters know of a philanthropic organization that would like to fund such a public interest lawsuit?
