Dear Supporters,

Here is an update on my Pro Se lawsuit against NHTSA and the FDA for failing to test and evaluate LED headlights.  If you are interested in reading through the legalese, you will notice that your own government is fighting not for you, the citizen, but for all the bureaucrats at NHTSA and the FDA.  They are trying to get my case dismissed, rather than act to protect our eyes from blinding LED headlights.

September 23, 2024 – Mark Baker, President of the Soft Lights Foundation, filed a lawsuit against the US Food and Drug Administration and US National Highway Traffic Safety Administration for failure to comply with 21 U.S.C. 360ii(a)(6)(A) and maintain a liaison for LED vehicle headlamps, and against the FDA for dissolving TEPRSSC, in violation of 21 U.S.C. 360kk(f). December 3, 2024 – The FDA/NHTSA filed a Motion to Dismiss. December 5, 2024 – Plaintiff filed a Response to Defendant’s Motion to Dismiss. December 17, 2024 – Plaintiff filed a Petition for Writ of Mandate, Rule 26(f). December 23, 2024 – DOJ filed a Response to the Petition for Writ of Mandate.

I went to battle today with Melanie Rhinehart, Chief of Staff for Representative Mike Thompson, to get a meeting directly with Representative Thompson.  After rejecting her efforts to have me fill out a form, I received this reply, "Thank you for your patience.  We will be in touch regarding the Congressman’s schedule after the first of the year." That's basically a non-answer, but I will be contacting them in January.  I will be asking Representative Thompson to hold a news conference about Headlightgate.

Sincerely,

Mark Baker
