The racketeering allegations include predicate acts of mail or wire fraud, and predicate state law crimes including obstruction of justice and child abduction.. The alleged federal crimes also include the theft, misuse or conversion of federal funds received by the court. The incident led to the judge's wife filing for divorce. Currently, Judge Matthew Gary reportedly has a consensual, but nonetheless improper relationship with his court clerk, Christina Arcuri. Under state law (CCP § 170.1) this constitutes a conflict of interest that requires, at a minimum, disclosure to parties and attorneys.
