We approached the court with our greivences but the CBI? The Investigating Agency itself? It is already a shame that the most important evidence is not already on record (despite being known to the CBI). But of all people, the Investigating Agency should be expected to be most interested in having all evidence disclosed. It should make the court even more suspicous of what is going on here, if the CBI itself is attempting to suppress certain evidence. As we had mentioned in our previous hearing the most crucial among others is the BlackBerry data, including GPS history, which CBI has failed to obtain, still needs to be - and can be - recovered from BlackBerry under the international standard procedure. Ironically, this very data could swing the case in both directions. So both the CBI and the Accused - if he is not guilty - he should have every interest in disclosing the BlackBerry password to recover its data and GPS history. Another issue here is the photographs of the diseased jiah and the crime scene. Interestingly, the official police pictures of the Deceased's body and crime scene were not even part of the charge sheet, nor were they ever presented to the PM doctors to ask for a convincing forensic explanation for the injuries that has been mentioned by them In The PM report, questioning whether such injuries can be caused with soft Muslin ligature is not clarified. Also please take a look at the picture (exhibit the imprint injury in Jason Payne report). Clearly, one doesn't need to be a medical expert to see that this is an imprint injury from a blunt object with a hard circumference, and certainly not caused with the knot of soft Muslin cloth. The PM doctors of jj hospital have stated this in their report and has mentioned that this could have been caused due to a hard blunt object, or if with the ligature but the ligature needs yo be verified for final say. Here it is clear that the CBI and the police never provided all evidences with any information about the nature of the ligature, to the PM doctors i.e. the soft muslin dupatta.
