I will be formally submitting a letter to Gov. Jerry Brown this week regarding our support numbers of our petition. I would like to get to 160,000 supporters by the time I submit this letter. I also notified his staff that I would like to have a personal meeting with the governor. The governor’s office already has our petition, comments, and signatures that I had served last week. So I believe the governor and his staff has had ample time to read it, now they need to respond. Kenneth Clair is scheduled to appear in Orange County Superior Court on February 19th. We will turn out there in support of Mr. Clair. I will let everyone know in an update if that is going to happen. Mr. Clair is fighting this re-sentencing. Mr. Clair is trying to have the 9th circuit review the DNA and other exonerating evidence before he is re-sentenced. However, the DA’s office is anxiously trying to re-sentenced Mr. Clair before he can have DNA and his other exculpatory evidence heard. The DA’s strategy is to re-sentence Mr. Clair, and take away his right to a 9th Circuit hearing to so that DNA and other exculpatory evidence will never be heard. Re-sentencing would take away Clair’s counsel because Mr. Clair is indigent. If Mr. Clair is re-sentenced he will not have paid appointed counsel. This is why we are pushing this case really hard for exoneration. This prosecution “win at any cost” justice system will keep Mr. Clair in prison for the rest of his life. This is not fair for Mr. Clair when DNA evidence clearly incriminates someone else. If the DA refuses to identify this person, then the DA should exonerate Mr. Clair. However, we know that will not happen. So again, I am asking everyone to get out the petition, donate if you can, and write letters to Governor Jerry Brown. Please help in whatever way that you can.
