There will be a rally on Wednesday, February 3, 2016, in the Santa Ana Civic Center in the “Plaza of the Flags”. The rally will be made up of local speakers and the community of justice minded people who are tired of how justice has been administrated in Orange County California. This is a fund raising event. The rally will start at 12:00 Noon. Set up time is 10:00 AM, so if you are from the press, or speaking at this event, please be early. The event will end at 2:30 PM.
The interest in this petition started because the Orange County District Attorney has been under investigation by the State and Federal Government because the District Attorney’s use of Confidential Informants and the District Attorney’s withholding exculpatory evidence in criminal cases.
On November 15, 1984, 5-year-old Jerrod Hessling witnessed the beating, rape, and stabbing death of his babysitter. When asked to describe the killer, he said, without hesitation, that it was a white male. Another child present during the murder saw a white man’s tattooed arm reach inside the house to open a sliding glass door.
Yet somehow, the lawyers in the case determined that Kenneth Clair, a dark-skinned African-American homeless man who had been squatting next door, was the killer. When Jerrod saw him on the witness stand and insisted they had the wrong man, the prosecution chalked it up to youth and trauma and pursued the death penalty for Kenneth Clair.
But that’s not the biggest bombshell in this case -- in 2008, forensic testing revealed that DNA found on the murder victim did not match Clair’s. The DNA matches another individual, but the Orange County District Attorney will not reveal that individual because the District Attorney says that the individual is out of the country.
As to Clair, the District Attorney wants to re-sentence Clair to life in prison without the possibility of parole. This way the District Attorney will never have to have the DNA evidence heard before a court because Clair will never have a trial. Is this a case involving a “confidential informant” being protected, or just another “win at all cost case”?
The Rally to Exonerate Kenneth Clair is just not about Kenneth Clair, but all the Kenneth Clair’s nationally that are imprisoned maliciously by District Attorney’s who have a “win at all cost” philosophy, and is aimed at ending “Prosecutorial Immunity” and making prosecutors criminally liable for these malicious acts that leave innocent people paying with their very lives in prison.
This rally will be the first stop of three to exonerate Kenneth Clair. The next stop is Sacramento to introduce a bill to the legislature to end “Prosecutorial Immunity” everywhere. The last stop will be Washington DC because the petition has gone viral and the President has to respond and get involved.
