Tod eines beschlagnahmten Hundes unter staatlicher Obhut – Forderung nach
Transparenz, Informationspflicht und strukturellen Änderungen

Diese Petition richtet sich an die Freie und Hansestadt Hamburg, den zuständigen Senat sowie die Fachaufsicht im Veterinärwesen.

Sachverhalt
Der Hund Carlos stand nach behördlicher Beschlagnahme unter staatlicher Obhut der Freien und Hansestadt Hamburg und war in einer Verwahrstelle im Tierheim Süderstraße untergebracht. Wie aus Gerichtsakten des Verwaltungsgerichts Hamburg (Az. 11 E 7530/25) hervorgeht, kam Carlos während dieser Verwahrung durch einen Angriff eines anderen Verwahrhundes zu Tode. Der Tod war behördenintern dokumentiert. Die zuständige Amtstierärztin Sabine Hillermann die diesen Fall betreut und den tot von Carlos schon am 17.11.2025 dokomentierte stand im regelmäßigen Kontakt zum Halter und trotzdem wurde der Halter des Hundes nicht zeitnah informiert über den Tod, sondern erlangte erst Monate später durch Einsicht in gerichtliche Unterlagen Kenntnis von dem Geschehen.

Problemstellung

Der vorliegende Fall wirft grundlegende Fragen zur Organisation, Aufsicht und Informationspraxis bei beschlagnahmten Tieren auf. Insbesondere zeigt er, dass es offenbar keine verbindlichen Regelungen gibt, die eine unverzügliche Information von Haltern über den Tod eines beschlagnahmten Tieres sicherstellen.

Forderungen

1. Einführung einer verbindlichen Pflicht zur unverzüglichen Information der Halter bei Tod oder schwerer Verletzung beschlagnahmter Tiere.

2. Einheitliche Dokumentations- und Meldepflichten bei Todesfällen in Verwahstellen

3. Regelmäßige unabhängige Kontrollen von Verwahrstellen beschlagnahmter Tiere.

4. Transparente Zuständigkeiten und Verantwortlichkeiten innerhalb der Behörden.

Diese Petition dient nicht der Schuldzuweisung an einzelne Personen, sondern der Verbesserung struktureller Abläufe zum Schutz von Tieren und zur Wahrung der Rechte der Halter. 

Death of a Confiscated Dog Under State Custody – Call for Transparency, Duty to Inform, and Structural Reforms

This petition is addressed to the Free and Hanseatic City of Hamburg, the responsible Senate, as well as the supervisory authority for veterinary affairs.

Facts of the Case
The dog Carlos was placed under state custody following official confiscation by the authorities of the Free and Hanseatic City of Hamburg and was housed in a holding facility at the Süderstraße Animal Shelter. As can be seen from court records of the Hamburg Administrative Court (Case No. 11 E 7530/25), Carlos died during this period of custody as a result of an attack by another dog held at the same facility. The death was documented internally by the authorities. The responsible official veterinarian Sabine Hillermann, who was in charge of this case and documented Carlos’s death as early as 17 November 2025, was in regular contact with the owner. Nevertheless, the owner of the dog was not informed in a timely manner of the death, but instead became aware of the incident only months later through access to court documents.

Problem Statement

The present case raises fundamental questions regarding the organization, supervision, and information practices concerning confiscated animals. In particular, it shows that there are apparently no binding regulations ensuring the immediate notification of owners about the death of a confiscated animal.

Demands
Introduction of a binding obligation for the immediate notification of owners in the event of the death or serious injury of confiscated animals.
Standardized documentation and reporting obligations in cases of death in holding facilities.

Regular independent inspections of holding facilities for confiscated animals.
Transparent responsibilities and accountability within the authorities.

This petition is not intended to assign blame to individual persons, but rather to improve structural procedures for the protection of animals and the safeguarding of owners’ rights.
