
On the evening of 3rd June 2019, members of the public called Police Scotland to report Robbie Smullen was violently attacking a young boy at a play park. The eye witnesses described what was happening as it happened and identified Robbie Smullen as the violent attacker. A short time after, the members of the public who had contacted the Police saw a Police vehicle arrive at the end of the street; they put the victim of the assault, who had managed to free himself and stagger away into their vehicle and drove off. The members of the public called Police Scotland again to say they had apprehended the victim and they needed to come back for Robbie Smullen, who was still in the area behaving aggressively punching the air. He had a metal knuckle duster or chain wrapped around his fist, but the Police did not return to apprehend him, despite knowing he was subject to several bail orders and a curfew the Police were supposed to be managing. He should not have been out among the public after 7pm and it was well past this time. Robbie Smullen then walked to another area of the city and violently attacked another boy with a metal chain. (the eye witnesses to the first attack said he had a metal chain or knuckle duster). A short time after that Robbie Smullen went on to stab Barry to death
Police Scotland withheld the details of the first reported assault from their investigations into Barry’s murder, so despite the fact there were eye witnesses, who identified the attacker as Robbie Smullen and who identified the victim as the boy Police Officers put into their vehicle when they arrived on the street, Robbie Smullen was not criminally charged. These officers of Police Scotland perverted the course of justice for their own reputational benefit, because they did not want to admit the terrible negligence of failing to apprehend Robbie Smullen much earlier, when he was at large on a spree of violence, while in breach of several bail orders and a court ordered Police curfew.
We have made a formal complaint to Police Scotland but they have not yet owned up. All their internal investigators need to do is listen to the calls reporting Robbie Smullen’s violent attacks, read the statements officers took from the members of the public days after Barry was murdered and compare with what the Police said to our family and the Crown Office, which was that an earlier report was not corroborated.
Interestingly the eye witnesses to the second assault also described Robbie Smullen as behaving aggressively and punching the air!
These officers of Police Scotland should be in prison. They withheld evidence to manipulate a narrative, just to hide the terrible negligence that led to our child’s death. What else have they covered up in this case and other cases?
