Jersey divorce law: Matrimonial Causes (Jersey) Law 1949 revised edition showing the law as at 1 January 2013, article 8. Restrictions on petitions for divorce during first 3 years after marriage. In my personal opinion this law is very much out of date and requires a revision particularly to Article 8 which states that no petition for divorce shall be presented to the court unless at the date of the presentation of the petition 3 years have passed since the date of the marriage.
I married in June 2014 and unfortunately the marriage broke down before the end of the year, I was left in a complete state of devastation which was increased on further discussions with numerous legal experts who advised me that Jersey law require couples to be married for a period of two years from the matrimonial date and separated for an additional year and one day before a petition may be presented to the court. Not only have the past two and a half years been stressful and a mental struggle at times to heal and grieve from the marriage breakdown, some of those unwanted feelings will resurface over the next few months when the current three year period has passed and I am finally able to present the court with a divorce petition.
I believe as a responsible adult if one is capable of making a decision to enter into a matrimonial commitment, should unfortunate circumstances arise meaning the relationship is left with irreconcilable differences each individual is able to come out of the marriage within a lessor time frame or any timeframe dependant on circumstances.
Marriage should not be entered into lightly and when I took my matrimonial vows I believed I was sharing my future with my life partner, unfortunately this has not been the case and I would like to prevent anyone from experiencing a similar scenario in the future, therefore please sign this petition and help revise Jersey's Matrimonial Law.
