Hi all,
Some of you who lodged ACCC complaints will have already received the staccato letters from the ACCC advising in various words that the thorough investigation of Members complaints is all to hard for them and as verbally advised to me ASIC it seems. The letter basically says that much time has passed since Medibank's chairman said the fund belonged to members and it would be hard to investigate and get prosecutions amongst other things.
Having read the letter iam furious that such an indolent approach to the investigation has been taken by the ACCC and ASIC given a clear body of evidence exists as to the virtual theft of this fund from its members by our government and moreover that the officers in charge of the fund from its inception are prepared to support the ACCCs investigation
Below for your information is my response to the ACCC emailed a short time ago, next steps from hereon are full attention to a getting a class action moving against the Commonwealth! I will come back to you on this.

Response to ACCC and indirectly ASIC
Dear Nick
I appreciate your advance call today, your advices were not what I expected or indeed wanted to hear as discussed, much less the contents of your letter forwarded directly afterwards.
I firmly believe the ACCC and ASIC based upon your advices have failed in this investigation to expose a great fraud and deception against members of Medibank Private, the Australian community, and indeed our great democracy. There is after all great merit in government authorities and commissions pursuing what is right despite legal remedies expiration, investigative time spans and the like as relied upon here by the ACCC as causal factors In not proceeding to fully investigate this matter from the inception of Medibank Private.
The proposition and statements in your letter Page 3, Para 1 (in relation to the various government and PHIAC legislative and regulatory changes since 1998, which have been described variously as "Tantamount to the Theft of Medibank") rounded with such a broad claim that "Consequently members of Medibank were on notice of this legal position from at least that time" are clearly wrong if the ACCC does not hold physical proof that members were indeed notified of all changes in writing by the Commonwealth or Medibank Private delivered to their registered address, and moreover that these notices expressly removed the previous warranty to Medibank members that inter alia "all funds were nett of modest administrative expenses used for the sole benefit of members", this most notably due to the fact that Medibank would from 2009 pay dividends to the Commonwealth and that the Commonwealth would go on to sell Medibank Private.
Further in relation to your letter Page 3, Para 2 (inserted below) which demonstrates a very indolent approach by the ACCC and ASIC given that the very statements made by then Chairman of the Health Insurance Commission in 1988 lay at the very heart of any "Fundamental" investigation of members complaints. For your information the writer was able to call the Chairman by phone, his number is in the White Pages in Sydney for your reference. In addition the writer has previously corresponded with the ACCC to advise that the founding General Manager and a long serving CEO of the Health Insurance Commission and indeed Medibank Private had agreed to make themselves available to the ACCC for historical mapping of events etc etc.

I can not believe that the ACCC or ASIC will not investigate this matter thoroughly and without your stated limitations which I might add will never reconcile with doing what is right!
In the end this matter will go before the courts and judgements here i confidently believe will be the source of greatest embarrassment to the ACCC and ASIC for having not fulfilled their fullest responsibility and duty to the Commonwealth of Australia's citizens rather than its more defined body politic!
