We are saddened to share that Dusty is being denied the opportunity to walk out of the prison gates on the day of his release .
We have been informed that Dusty will instead be transported by VADOC correctional officers directly to a Probation & Parole office, handled in a manner typically reserved for individuals classified as Sexually Violent Predators (SVP). This is deeply troubling.
One of Dusty’s convictions carries a sexual offense label, abduction with intent to defile, a crime he was wrongfully convicted of. He was formally evaluated in December and was not classified as an SVP. In addition to that assessment, his COMPAS risk assessment further reflects that he does not pose a risk to society. Despite these findings, he is now being treated as if he were a sexual predator. There is no Virginia law, mandate, or VADOC operational procedure that requires this process. For these reasons, we are asking Dusty's supporters to contact the Virginia Office of Public Safety & Homeland Security and the Governor of Virginia to respectfully request that Dusty be allowed to walk out of Greensville Correctional Center on his release date.
