The Blantyre City Council (BCC) sought to vacate the injunction on three grounds-that the claimants suppressed material facts, that the balance of justice lies in favour of vacating the injunction and that there is no status quo to be preserved in the circumstances..The BCC failed on all the three grounds to vacate the injunction we took to stop them erecting the statue of racist Mahatma Gandhi.
