The sections concerning the punishment relating to such crimes should be re-looked and updated as in the reasonable course of life it does not serve the fair and right punishment keeping in mind the agony, torture, harassment and suffering the girl goes through. It should be a non-bailable offence and all the cases under this section be made to appear in the fast track courts.
The minimum punishment for offence under 376 should be not less than life term and maximum be of death. This theory of punishment is backed with the idea that the society may not a need a person who has been involved in the offence of rape and re-habilitation of such a person is next to impossible. In cases of gang rape the judge should take all due care to protect the identity of the victim and the only punishment be given be of death as the victim will also be under the agony and torture throughout her life. Further a monetary compensation should also be added. This will help the victim to re-structure her life may not entirely but partially. In refusal or denial of such fine the personal property may be attached to get the compensation reach the victim.
Further a special court be made by an order, which is only dedicated for such cases e.g. the Terrorist anti disruptive activities court or famously known as the TADA court which specializes only in terror activities.
Such courts should be led by female judges and the court be restricted to only the aggrieved parties and no public should be allowed in such courts in order to make the victim feel comfortable. Also the IO or the investigation officer be not less than of an ACP rank and should be female thereby making it easy for the victim to help the authorities in the investigation
To add let the special provision of rape of a wife be continued and dealt in the way it is written but the general principal and the punishment be amended.
Further such cases should work within a stipulated time frame thereby getting speedy justice as well all have heard of the famous line “justice delayed is justice denied”

By such an amendment
- The women is guaranteed justice
- No way the accused is let off
- High time the old IPC be amended as the offences as getting heinous day by day.
- Stringent will obviously be a tool of constant fear in the mind of offenders
- Special courts will help in victim protecting the identity of the women thereby protecting her from becoming a society fool.
- We don’t need such rapist to survive in our society. Better to put them behind the bars forever or serve them with death.
