Petition to the Minister of Immigration, Refugees and Citizenship to review the 2019 submission process of interest to sponsor parents and grandparents form

Whereas:

●       Canada is founded upon principles that recognize the rule of law;

●       Section 15. (1) of the Canadian Charter of Rights and Freedoms states that every individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular, without discrimination based on race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.

●       The 2015 Election Platform of your government states that if elected, it will establish new performance standards for federal services because Canadians deserve better service, including immigration, from their government.

●       The Platform also mentions that if elected, it will take immediate steps to reopen Canada’s doors, and will make reuniting families a top priority.

●       Your mandate letter from the Prime Minister states that one of your top priorities, as the Minister, is to improve the department’s service delivery and client services to make it timelier and less complicated.

●       In your statement in May, 2017 you mentioned that the changes to the intake process for the Parent and Grandparent Program were about ensuring fairness by giving all interested sponsors equal access to the application process.

●       The 2019 submission process of interest to sponsor parents and grandparents form was discriminatory and has raised many concerns about the fairness of access, as only those with reliable Internet access, quick typing skills and good understanding of English or French had a chance to succeed. These are not sponsorship criteria, and should not have been the deciding factors in the process.

●       The 2019 submission process did not provide a fair chance to people with disabilities, which impede them to type or read fast enough.

●       Immigration, Refugees and Citizenship Canada’s (IRCC) instructions on how to complete the 2019 interest to sponsor form advised that it would take about 10 minutes to complete, but the quota for the year was completely filled and the application form was removed from the website in much less time.

●      The 2019 submission process of interest to sponsor parents and grandparents form also had technical issues. For many hopeful sponsors the link to the form just was not available on the IRCC’s website. Therefore, they were not given an equal access to the form and a fair opportunity to sponsor their   parents and grandparents.

●       All citizens of Canada regardless of their physical ability, Internet access, quick typing skills and good understanding of English or French should have equal opportunity to submit the interest to sponsor parents and grandparents form.

We, the undersigned, citizens and permanent residents of Canada, call upon the Government of Canada and IRCC to:

1.     Conduct a comprehensive analysis of the technical issues that many sponsors experienced during the 2019 submission process of interest to sponsor parents and grandparents form (please see  visual evidence of technical issues  in ANNEX). These technical issues were also confirmed by the IRCC’s tweet at 12:06PM EST stating that the form will be live momentarily (please see the visual evidence of the deleted tweet in ANNEX).

2.     Explain in writing why thousands of Canadians have not had access to the form at an indicated by IRCC time.

3.     Provide in writing and disclose publicly the following information: 

●       Number of submitted interest to sponsor forms by province and territory

●       Breakdown of number of persons being sponsored to a single sponsor

●       Number of submitted interest to sponsor forms at each minute mark (from 12 PM EST until the form was taken down)

●       Number of duplicate interest to sponsor forms submitted

●       Number of eligible for further actions forms out of 27,000 submitted forms

4. Re-open the 2019 submission process of interest to sponsor parents and grandparents form after all occurred technical issues are reviewed and corrected to allow all Canadians and Permanent Residents fair and equal opportunity to apply.

5. Establish a working group between IRCC and civil society to improve the Parents and Grandparents Sponsorship Program for 2020.This working group will serve as a platform and an opportunity for sponsors to raise concerns and discuss feasible solutions to this ongoing problem that the Government of Canada has failed to properly address.

TECHNICAL ISSUES:

 

Through IRCC Facebook page thousands of applicants claimed to have never been able to access the form whatsoever. See screenshot 1 & screenshot 2, where one shows that the time is 12:07 pm EST and the form is not available as it still displays the message that form will be available at noon EST. The second screenshot also shows the same and has the timestamp of 11:05 PM (SK time). This is clear evidence that the form was never available to the applicants.
To confirm that the problem did not lie with the applicants but with the ministry's systems, there is a tweet by IRCC that was shortly deleted after posting (screenshot 3) where they have acknowledged at around 12:06 pm EST that the form will be available momentarily. IRCC was aware of the technical issues, but did not take the measures to correct the unfair process and then closed the systems at 12:08 PM (not 12:11 pm as many media reports are showing).
Many people received errors when they submitted their forms and these errors were not due to a failure of applicants putting any information incorrectly or incompletely (screenshot 4). This error resulted for no reason and again confirms that this is a technical glitch.
