This has enabled us to serve the Home Office last Friday with our letter before action telling them why the ongoing refusal to make decisions on Myrtle's outstanding application for further leave to remain and her application for a change of visa conditions (to allow her access to public funds) is unlawful.
As you know Myrtle has already been waiting 8 months for a decision on her leave to remain application and 6 months on her change of conditions application.
The Home Office has given no reason for the delay and expressly refused last month to expedite her applications even though they know she's terminally ill and suffering from end stage heart failure.
It seems that they are waiting for her to die to prevent the possibility of her having access to public funds to avoid her and her daughter falling into destitution.
We have given the Home Office 48 hours to put the situation right by deciding Myrtle’s applications, rather than continuing to delay them.
We are hoping that the Government will now finally do the right thing, stop stalling and grant Myrtle’s applications without further delay.
If they don’t, we will have to take the Home Office to Court in a judicial review. We will, of course, keep you informed.
