Result of Hearing re PACE complaint – Dr Myhill vs IC & GMC

WE LOST.....

But it was a split decision, by 2-1, with a dissenting vote by Mr Malcolm Clarke who said that:
“I conclude that Dr Myhill’s legitimate interest in seeking this information, if it exists, as a practising doctor with patients, who has a deep professional interest in ensuring that national recommended treatments in this area of medicine are evidence-based, is a very strong one ... I therefore conclude that ……Dr Myhill’s legitimate interests are not overridden by the rights and freedoms of the data subjects”.

It is very important that we have this minority view on the Public Record.
We are not giving up and the fight continues – please watch this space!
We have learned a lot through this process, and we now have a clear plan as to how we can circumvent the niche legal point raised by the GMC.
Remember – we ALWAYS win in the end, and so if we haven’t won yet, then it isn’t the end.
