After speaking with the superintendent she will be speaking to the principal again to make a "plan" for my son to report directly to the principal (exactly what the principal already said) but when asked if something would actually be done and the child consequenced after my son reports an incident I got half answers and no confirmation of actual discipline. My son was categorized as putting himself in the middle of a situation when we discussed the time he was punished for pulling this child off of another one to protect the other child and when I said yes and I am proud of him for sticking up for someone being bullied and her response was that of disapproval. As far as the ban on my husband they will not remove it because apparently "multiple witnesses" saw what happened and corroborate the gym teachers story including the vp and principal claiming to be present when it occurred despite the fact they were called out after the fact in response to the situation. Nothing is being done to the teacher for his aggressive behavior despite me.explaining my conversations with past students and other parents concluding he has a history of aggressive behaviour.  So my husband remains banned for something he didn't actually do but this teacher gets to remain teaching our children. Makes sense.
