Good news about our LPAT appeal to save Waverly Woods! At a recent Case Management Conference (CMC), hearing dates were confirmed for April 25, 2022 – May 13, 2022. Although, currently, all hearings are being held virtually, it was agreed that if COVID-19 restrictions are lifted, the hearing will be held live in Fort Erie, so that residents will be able to attend in person. Our lawyer, David Donnelly, has sent a letter to the Town of Fort Erie asking them to book the council chambers for the hearing dates and to make sure the facilities are kept available. If you are interested in attending any of Hearing, please contact the town to let them know you want to attend in person and to make sure the chambers or a bigger facility are booked.
A notice of motion was initially put forward by the developer’s Counsel proposing to reduce the number of days for the hearing. The motion was subsequently withdrawn, as it did not result in obtaining an earlier date. Questions were raised by the CMC Chair regarding several inconsistencies listed in the notice of motions put forward by the developer regarding the description of the proposed plan of subdivision. These were acknowledged by the developer’s Counsel and clarification was provided.
The CMC was definitely a win for our side and we are pleased with the outcome. Our hope is that COVID-19 will be under control, and that the community will be able to access the hearing in person, which is expected to be extremely well attended. Having an in-person hearing will allow access to everyone, regardless of their technical expertise or capabilities.
