Please share this petition with others to ensure everyone in the area is aware of this proposed tower location in the sensitive environmental area along the Sabinal River near Lost Maples State Natural Area. We have reports of some folks having their efforts to make people aware of the issue silenced on local sites. This just means everyone needs to reach out individually to people who may not yet know about this. Please do this immediately. There are obviously people out there who benefit from folks not being aware of what is going on. (Please be advised signing this Change.org petition does not replace the need to file a formal Request for Environmental Review with the FCC on their website tomorrow.) Also, tomorrow morning please call our elected representatives and ask them to stop the FCC from imposing the petition deadline, which is tomorrow. The Public Notice that the tower company published in the local newspaper is flawed, as they did not specify the proper location of the proposed tower, and they listed the wrong FCC website address for people to access information. ACCURATE, ADEQUATE AND FAIR PUBLIC NOTICE IS REQUIRED BY THE FEDERAL COMMUICATIONS COMMISSION AS PART OF THE APPLICATION PROCESS. BRANCH TOWERS, LLC HAS NOT TECHNICALLY MET THE STANDARD AND ACCEPTABLE MEASURE OF THESE LEGAL PUBLIC NOTICE REQUIREMENTS. REFILING OF PUBLIC NOTICE IS WARRANTED IN THIS CASE AND WARRANTED TO AFFORD AREA RESIDENTS, LANDOWNERS AND OTHER INTERESTED PARTIES REASONABLE AND APPROPRIATE TIME TO FILE PETITIONS Critical errors in the official Public Notice filed and printed in the Bandera County Courier newspaper by Branch Towers, LLC have prevented many concerned parties from filing petitions. While it is not assumed the printing errors were intentional or strategic on the company’s part, the errors include an incorrect description of the proposed tower, a confusing and incomplete description of the tower site location, and most critically an invalid FCC website page address to access the application. This lack of accurate information and the inability to access the actual application on the FCC website results in corrupting the process the Commission has established to promote fairness and invite input from concerned or opposing parties. These errors have combined to create undue confusion, stress, hardship and delay for those attempting to access accurate information about this proposed tower application. For these reasons, we respectfully request that the company be compelled by the Federal Communications Commission to make valid and accurate Public Notice of their plans. It would also be reasonable and appropriate for the Commission to reopen the filing period for petitions for a period of 30 days after a factually correct public notice has been made by the company that allows easy access to the official application on the FCC website.
