As the issue is so important, Switzerland were everything is top quality but when it comes to justice and human rights respect we are still far behind. Therefore for awareness about how a SVP political membership holder becomes member of the Zurich High court and he is not a president of III Criminal chamber of the canton of Zurich Supreme court is quite concerning. Victims are not getting justice in supreme court of the canton of zurich and this is not an isolated case therefore to awake the citizens flyer distribution is going on.

This is related to Senior judge and president of III criminal chamber of Supreme court of the canton of zurich lic. iur. David Oehninger. In 2017, David Oehninger was elected to the Zurich High Court in what observers described as an exceptionally contentious and opaque process. It appears that some commentators considered him less qualified than his opponent, Andreas Huizinga (EVP). He was seen by many as politically polarizing due to his SVP membership, and it appears he did not enjoy broad parliamentary trust at the time. 

Reports indicate that a significant portion of parliament opposed his election, citing concerns about his party affiliation.

The Inter-Party Conference (IFK), which normally agrees on a consensus candidate, failed for the first time. Despite all this, David Oehninger became a member of the Zurich High Court. Today, he is the President of the III Criminal Chamber.

A recent judgment (TB250057-O/U) has raised concerns among legal observers about whether the Zurich High Court fully addressed all aspects of the case. The matter was particularly serious, as the accused is a staff of the Zurich Cantonal Police. According to the court record, substantial evidence was presented regarding alleged misuse of power by the officer. However, the case was ultimately dismissed by President Oehninger, which some commentators have noted has prompted debate about how such cases are evaluated.

Victim will file an appeal, but as a aware journalist in Zurich I am also making the court order publicly available so that everyone can read it and understand how the judiciary system in Switzerland is ‘broken’. Over the past several years, some Swiss police officers have committed cold-blooded killings of innocents and yet they have never been punished. In most cases, they are acquitted. 

In this case, however, where extensive evidence exists, the court still acted in a biased manner. There are pattern of misjudgement by Supreme court of the canton of zurich. Therefore, the concerns raised in 2017 about Mr. David Oehninger’s SVP political affiliation appear is justifiable or not? How many cases have been dismissed like this and burried in case files and how many victims remain without justice, only God knows.
