After serving one year as Chief Trial Counsel for the California State Bar, James Towery was forced out of the attorney watchdog agency and then landed in Santa Clara's Family Court. Local lawyers familiar with James Towery's reputation as a womanizer and incompetent business lawyer, knew to steer clear of Towery's court. Court files show a large number of 170.6 disqualification motions were filed against Towery, as lawyers made moves to protect their client's from what they knew to be an unfair hearing before Towery. One court whistleblower has reported that during the course of one such disqualification, James Towery who was facing a writ (likely to mar his new appointment) , appears to have backdated paperwork to avoid the writ, protecting his career over the law. Retired court clerks , and others, have long wondered why a new judge would be willing to risk their career by back dating legal documents , which is in fact a crime. What court clerks and others in the Santa Clara County Family Court don't wonder anymore is if James Towery could be a fair and ethical judge given the controversy surrounding him at the State Bar. Nobody is wondering, because Towery's record and personal conduct more than shows unethical and criminal like conduct from the bench is not just a possibility, it is a reality . Santa Clara County Courts have known about James Towery's questionable conduct, and have not lawfully addressed it to protect the public , and the integrity of the legal system as they are paid with public funds to do.
