Osman v. Peake of 2008 followed by Devins v. Collins of 2026--Finally! Watch ASAP to Support

We only found out about Devins v. Collins following our Capitol Hill round table, so it's been a busy few months setting up support for that case in the courtroom.  The fact pattern was much like Osman v. Peake, but the father veteran died over a decade ago while the kids were in middle school; they both now aspire to be doctors much like Brian Osman decades ago.

Though it wasn't LA Law, 30 September went very well for the young appellant; the written decision should be out by late 2026.  By the end VA's attorney kept telling three federal judges (one of whom was commissioned into the Army JAG Corps with her husband in 1974!) that he hadn't expected to face questions about how compensation and educational benefits interface--and in fact, really doesn't know how VA operates.  It's well worth watching for that alone.  Plausible deniability is a poor tactic to use in a federal courtroom; however, our big concern remains how to force VA to circle back and make whole all those wrongly denied full benefits since 8 October 2008 when Osman was decided in favor of dual eligible child students and VA failed to appeal.

You can help by watching the YouTube video posted on the United States Court of Appeals for Veterans Claims NOW--every view helps us going into a meeting with VA central office staff on 21 October.  Reach it by typing www.uscourts.cavc.gov and scrolling down slightly where you'll find the YouTube channel on the right hand side; Devins v. Collins was heard on 30 September.
