I received an update from US DOL today, and the investigative team now refuses to review/re-review evidence I previously submitted but was missed/ignored - and even refuses to review my previously submitted allegations of what my protected activity was & what Apple's retaliation was, even though it was also previously ignored/missed.
During the nearly three hour long phone call with US DOL on January 2023, it became clear US DOL reviewed almost nothing I sent them (including ignoring my complaint & rebuttal statement, the bare minimum in any action), US DOL said they would review/re-review all material content previously missed, as captured during the recorded phone call. Last night, I sent the US DOL team the transcripts from the call, where they said they would review this information, & yet this morning they are now doubling down that they will only review new information (not anything previously sent, even if it's 95% of the evidence for my case that they never reviewed).
I had also notified US DOL about my win with NLRB: that NLRB issued a decision of merit that Apple's NDAs & employee policies violate federal labor law. I sent articles that quote the NLRB press office and explain generally what was found and that Apple may settle before a complaint would be issued. US DOL responded asking for an "ALJ decision" to review, implying that US DOL would not accept a "decision of merit" as evidence in my case, and it would be up to Apple's discretion whether they settle or go to trial (which only then would result in the decision that could then be used in my US DOL case).
Marty Walsh quit US DOL yesterday to go play hockey instead. US DOL seems to be further empowered in his absence to unleash blatant witness intimidation, obstruction of justice, & anti-labor statements & conduct.
Please sign & share my petition, because the worst part of all of this is that I'm only one of dozens, maybe even hundreds, of conscientious whistleblowers who risked to all to help others, and were rewarded with this egregious misconduct & further retaliation by this US-tax-payer-funded federal "labor" agency.
