The NSW Government has moved to “put an end to the privatisation of democracy” with new legislation that will ban the use of private election providers in local council elections across New South Wales.
The proposed reforms follow widespread outrage after the 2024 elections in Fairfield and Liverpool, where privately-run polls saw “unacceptable waiting times,” ballot shortages, tabulation errors, and even the sudden closure of polling stations, prompting chaos and confusion.
“Elections should be run by trusted professionals – not outsourced to the lowest bidder,” said Member for Liverpool Charishma Kaliyanda, recounting the closure of the major polling hub at Cecil Hills High School.
“These reforms will restore faith in the way our councils are elected.”
Member for Leppington Nathan Hagarty added, “The use of private election providers in last year’s local elections failed to meet the standards our community expects.”
“This legislation will ensure our elections are fair and transparent.”
Under the changes to the Local Government Act 1993, only the NSW Electoral Commission will be authorised to conduct council elections, cementing a single, trusted authority to safeguard local democracy."
MARCH and APRIL 2026
The ELECTORAL LEGISLATION AMENDMENT (ELECTIONS) BILL 2026 was passed in both Houses of NSW Parliament on the 27th March 2026 and became law on the 7th April 2026.

The NSW Electoral Commission is now the only organization that will run NSW Council elections across the state of NSW.
After the debacle of an Election in September 2024 for the Liverpool City Council Elections run by a private company this is, in my opinion, a win for the community.
