🚨Hagerstown Is Hiding Its Data Center NDA. Show Up Tonight to the Hearing and Ask Who Pays. 💸

Hagerstown Rapid Response …Hagerstown, MD, United States
Oct 27, 2026

City Hall wants public input while withholding its agreement with the developer. Nearly $31 million in wastewater contracts is also on tonight’s agenda.

Hagerstown officials met privately with data center developer Diversified Capital and still refuse to release their nondisclosure agreement. Tonight, they want residents to comment on annexing the developer’s property into the city, where Washington County’s data center moratorium would not apply. Apparently, we’re supposed to participate without seeing what our government agreed to.

As we reported, tonight’s agenda also includes nearly $31 million in wastewater contracts, while the broader upgrade funding plan budgets $0 in direct developer contributions. Officials need to explain whether data center demand influenced those plans and how much existing customers will pay. Meanwhile, references to data centers appear on just one page of the 567-page packet, in a contractor’s cleaning-services marketing material.

Officials who put NDAs with data center developers before residents should leave office.

Join us tonight, October 27, at 6:45 p.m. at Hagerstown City Hall, 1 East Franklin Street, before the 7 p.m. meeting. Tell officials to release the NDA, explain the costs, and give residents time to review the information before a final decision. You can also sign the petition at StopTheNDAs.org.
