The consultation day proved to be very interesting and highlighted the issues the EA have to deal with when permitting these industrial hen houses. Those who chose to attend found the day very informative, it gave them the opportunity to voice their concerns. This application is classed as an HPI (high Public Interest) and on that basis the EA attended with members from the permit team and our local team and what a great team they are. From the very start of this application, the agents have stated the distance from sensitive receptors have been anything from 225m to about 59, The EA have sorted this one out once and for all and stated the boundary receptors are a distance of ZERO. The initial permit application date was the 19th May; it’s taken the EA until the 15th September to gather all the required information to enable them to process this application, the reason for this is the agents have consistently failed to supply the requested information. The Planning process appears to have come to a bit of a halt, there is so much more information required to enable the strategic Planning Committee to have an informed debate. The red line boundary will have to be moved to cover the 160 acre boundary; if this is not done a judicial review is almost inevitable. The Council do face the possibility of a Non determination from the applicants; personally, I hope this happens for the simple reason the application will go direct to the inspectorate!! On that basis and the history of case law refusing very similar applications, this application will be refused due to close proximity to protected dwellings.
