Franklin Mayor Steve Olson has added the following agenda item to TONIGHT'S Common Council Meeting (Monday, November 2nd, 2020).
This means that the Mayor has chosen to open reconsideration of the Common Council’s vote from October 20th, 2020 to deny Strauss Brands, LLC Special Use application. There lies the potential to for this to be approved regardless of all our emails, phone calls and appearances over the past. There are questions as to whether not this is actually legally allowable based on the UDO code Section 19-7F (below)

Here are TWO important steps you can take to ensure our voices are heard.
#1- We need people to attend the November 2nd Common Council Meeting at 6:30 p.m. I request you and anyone you know to attend in person at the Common Council meeting and oppose the expansion. Each person will have a chance to give a statement for 3 minutes. You can still attend in person to show your support against the expansion even if you're shy giving a statement in person. COVID protocols are followed at this meeting including mandatory masks and 6 ft of social distancing.

WHERE: Common Council Chambers, City Hall, 9229 West Loomis Road (masks are required)
If you are unable to attend in person then please help by calling or emailing the Alderpeople below to let them know you oppose Strauss' Special Use.
#2- We need EVERYONE to call and email the Franklin Alderman (Numbers below) and tell them to MAINTAIN THE NO VOTE ON STRAUSS’ SPECIAL USE tonight.

Below are the options available after Special Use denial:
Reconsideration
UDO code 19-7F. It shall be in order for any member who voted in the affirmative on any question which was adopted or for any member who voted in the negative when the number of affirmative votes was insufficient for adoption to move a reconsideration of such vote, at the same or next succeeding regular meeting of the Council. A motion to reconsider having been lost shall not be again in order.
"No application for special use which has been denied [...] by the Common Council shall be resubmitted for a period of 180 days from the date of said [...] denial." 15-9.0103F
"Any person or persons [...] aggrieved by any decision of [...] the Common Council [...], may, within 30 days of the date of such decision, commence an action seeking the remedy available by way of certiorari in the Milwaukee County Circuit Court [...]. Such action for certiorari shall be the sole remedy of any [...] person(s) aggrieved." 15-10.0501
