REVERSESTING.ORG·SUNDAY, OCTOBER 15, 2017 Jeffrey Fagan is an Isidor and Seville Sulzbacher Professor of Law at Columbia Law School and Professor of Epidemiology at the Mailman School of Public Health at Columbia University. He is also a senior research scholar at Yale Law School, where he is a frequent visiting professor. His research and scholarship examines policing, the legitimacy of the criminal law, capital punishment, legal socialization of adolescents, neighborhoods and crime, and juvenile crime and punishment. In his report Filed Sept.23 2016, Professor Fagan provides empirical evidence to address two principal claims by defendants of the Stash House Stings set up by the ATF. The first being that defendants claim the ATF targeted Black and Hispanic people for recruitment into fictitious Stash House Stings, in violation of the equal protection principle of the Fifth Amendment. Defendants also claim, in targeting Black and Hispanic people for recruitment into fictitious Stash House Stings, the ATF recruited persons based on criteria and characteristics that were not specified as selection criteria articulated in the ATF Manual for this program. Professor Fagan shows how the ATF used a pattern of selective enforcement in the recruitment of Stash House defendants.
