How is it that he can claim a conflict of interest when he only hears from his agency which rejurgitates what the BESS developers say?
Additionally, another update we learned about is, Fergusen assigned the Chair position who has control over the EFSEC to a former lobbyist who represented Tenaska- how can that person who received income from Tenaska (and most likely other BESS developers) be impartial to approving/reccomending approval of Tenaska's proposed BESS (or other developer's BESS?

In short, after the evacuation orders were lifted five days after the Jan 16th Moss Landing BESS fire, San Jose State University Marine Lab researchers found toxic levels of lithium battery fire related fallout across their decade long researched research area in and around Moss Landing, Elkhorn Slough, and Monterey Bay which covered more than 2 mile radius. What they discovered when they compared 10 years of scientific evidence (soil and water samples), is a 100x to 1000x increase of lithium battery metals at toxic levels which will poison and kill the whole environment and all living things in the years to come.
Additionally, after San Jose University published their findings, a grass roots sampling collection was set up and sample takers were trained on all the requirements like chain of custody and took almost 200 samples all across Monterey County and surrounding counties as far out at 60 miles away. What the lab tests confirmed, is the toxins did not stop at the borders of San Jose Univiersty's 2-mile research area, the the toxins spread beyond 36 miles down wind- but at diminishing numbers. Toxic levels of fallout were found as far away as 27.2 miles down wind.
FALLOUT from BESS fires is toxic as there is irrefutable evidence...
There still isn't a lithium battery prevention solution nor an extinguighing solution- until there is lithium BESS are too dangerous to be sited anywhere near sensitive locations and sensitive environments.
