Change Minimum Sentencing for Criminal Negligent Homocide
The Issue
In a recent case of State vs Corbett the Defendant was convicted for Criminally Negligent Homicide. In Title 11, Chapter 5 of DE State Law, the maximum is 8 years in prison; however, the Defendant only received 18 months probation. He killed a child and got set free. This is a definite miscarriage of justice. Overall, punishment in most states ranges from six months to 10 years. I wish for Legislation in DE to make the minimum punishment 4 years with no chance of parole for any crimes for children who are killed due to criminal negligent homicide. The thought that a parent to lose their child in this manner and the individual convicted of this crime to only get probation is a clearly wrong. I want the new law to be called Evans Law.
