We the People of the State of New Mexico do hereby request a full investigation into the Secretary of State’s office, specifically, Secretary of State, Maggie Toulouse Oliver, for violations of the New Mexico Governmental Conduct Act, described in the following sections;

Per the 2006 New Mexico Statutes - Section 10-16-3 — Ethical principles of public service; certain official acts prohibited; penalty

A. A legislator or public officer or employee shall treat the legislator's or public officer's or employee's government position as a public trust. The legislator or public officer or employee shall use the powers and resources of public office only to advance the public interest and not to obtain personal benefits or pursue private interests.

B. Legislators and public officers and employees shall conduct themselves in a manner that justifies the confidence placed in them by the people, at all times maintaining the integrity and discharging ethically the high responsibilities of public service.

C. Full disclosure of real or potential conflicts of interest shall be a guiding principle for determining appropriate conduct. At all times, reasonable efforts shall be made to avoid undue influence and abuse of office in public service.

D. Any person who knowingly and willfully violates the provisions of this subsection is guilty of a fourth degree felony and shall be sentenced pursuant to the provisions of Section 31-18-15 NMSA 1978.

On March 5th, 2019, a Senate bill (Senate Bill 8) calling for background checks on private gun sales was signed by Governor Michelle Lujan Grisham. The People of the State of New Mexico believe this bill will do NOTHING to stop criminals and will ONLY infringe on the rights of law abiding citizens and is also a direct violation of the New Mexico Constitution Article II Sec. 6. [Right to bear arms.] that states, “No law shall abridge the right of the citizen to keep and bear arms for security and defense, for lawful hunting and recreational use and for other lawful purposes.

Per the New Mexico Constitution, Article IV Sec. 1

The people reserve the power to disapprove, suspend and annul any law enacted by the legislature, except general appropriation laws; laws providing for the preservation of the public peace, health or safety; except as in this constitution otherwise provided.

Therefore, the People of the State of New Mexico wanted to exercise our Constitutional Right to have Senate bill 8 recalled and a referendum initiated.

On March 21st, 2019 a formal petition to recall SB8 was submitted to the Secretary of State’s office and was rejected by the Secretary of State, Maggie Toulouse Oliver, stating, "It just doesn't meet the strict technical and legal requirements needed for it to be circulated,".
On April 12th, 2019, the petition was revised and submitted to the Secretary of State’s office. Once again, Secretary of State, Maggie Toulouse Oliver rejected the proposed petition saying the law was designed to improve public safety and is therefore exempt from such referendums.
On April 23rd, 2019, once again the petition was resubmitted and again it was denied by the Secretary of State, Maggie Toulouse Oliver, saying the repeal of a public safety law cannot legally be put to a public vote.

Secretary of State, Maggie Toulouse Oliver is taking out of context a sentence in Article IV, Sec. 1 of the New Mexico Constitution that states, “Laws providing for the preservation of the public peace, health or safety;” HOWEVER, she is deliberately omitting the line, “except as in this constitution otherwise provided”.  Herein, “otherwise provided” the New Mexico Constitution, Article II Sec. 6. [Right to bear arms] states;

No law shall abridge the right of the citizen to keep and bear arms for security and defense, for lawful hunting and recreational use and for other lawful purposes, but nothing herein shall be held to permit the carrying of concealed weapons. No municipality or county shall regulate, in any way, an incident of the right to keep and bear arms. (As amended November 2, 1971 and November 2, 1986.)

Senate bill 8 is clearly, an incident of the right to bear arms for immediate security and/or defense.

Considering all of the above, we the People of the State of New Mexico believe the Secretary of State, Maggie Toulouse Oliver has violated the New Mexico Governmental Conduct Act by;

·        NOT treating her government position as a public trust.

·        NOT using her powers and resources of public office to advance the public interest.

·        NOT conducting herself in a manner that justifies confidence placed in her by the people.

·        NOT taking reasonable efforts to avoid undue influence and abuse of office in public service. (We have petitioned SB 8 THREE times)

Therefore we the People of the State of New Mexico request the IMMEDIATE resignation of Maggie Toulouse Oliver as Secretary of State and/or a complete investigation for violating the provision of the New Mexico Governmental Conduct Act, which is a fourth degree felony and shall be sentenced pursuant to the provisions of Section 31-18-15 NMSA 1978.

We affirm this decree by signing of this petition and/or notifying the State of New Mexico, Albuquerque FBI Office at, (505) 346-7274 and explaining the above violations.
