"Today, I’m introducing the Survivors Empowered package with Rep. Laurie Pohutsky, Rep. Nate Shannon, Amanda Thomashow and Rachael Denhollander to give all survivors access to justice. Click here to read our press release: bit.ly/33VFqro.
86% of child sexual abuse goes unreported because Michigan’s statute of limitations is among the narrowest in the entire country. Archaic and outdated laws have closed the doors of justice for survivors for far too long. It’s time to give all survivors access to justice.
Michigan is the only state to pass a law restricting access to justice for survivors based on who the abuser was.
It’s not about who committed the abuse. It’s about survivors. This is about our sons and daughters, nieces and nephews, husbands and wives – who have been afflicted by a public health crisis that has been hidden for far too long.
All survivors need access to justice. That is why we worked with survivors and advocacy groups to introduce legislation to eliminate the civil statute of limitations in cases with a criminal conviction and to extend the statute of limitations to age 48 or seven years from the time the survivor realized they were abused, whichever is later.
Most importantly, the package would give all survivors who were failed by Michigan’s narrow statute of limitations a second opportunity to file claims against their abusers and those responsible by establishing a two-year revival window.
I want to thank everyone who helped us craft this legislation: survivors across Michigan, including Rachael Denhollander and Amanda Thomashow; the Michigan Coalition to End Domestic and Sexual Violence; the Firecracker Foundation; Child USA; and the Michigan Association for Justice and many of your members, including: David Mittleman, Mick Grewal, Jamie White, Andrew Abood, John Manly and Megan Bonanni."
