Stop Abusers From Weaponizing Family Court
Abusive parents must not be allowed to misuse the family court system—often with the help of unethical attorneys—to make false allegations, commit slander, and wrongfully remove children from a protective parent.
When an abuser manipulates the court through deception, false claims, or ex parte filings, the result is not child protection—it is legal abuse. Children are separated from safe, loving parents, and survivors are punished for seeking safety.
This conduct must carry real consequences. Parents who abuse the legal system to harm the other parent or control the children should face:
Criminal investigation for slander, fraud, and abuse of process
Immediate limits on custody, including supervised visitation only
Mandatory domestic-violence intervention, parenting classes, and psychological evaluation
Family court proceedings involving custody and domestic violence must be transparent. Courtroom recordings or cameras should be required to ensure accountability, deter misconduct, and protect children and parents from abuse of power.
Victims of domestic violence must be guaranteed access to attorneys and trained advocates. Legal aid is income-based, not need-based. Many survivors are denied help simply because they have a job—even when they cannot afford a private attorney and their safety and parental rights are at risk. Access to legal representation in domestic-violence and custody cases must not depend on income.
People born with disabilities or living with disabilities must receive full ADA accommodations in family court. Disability status must never be used to discredit, silence, or punish a parent. Courts must provide reasonable accommodations, accessible proceedings, and equal participation for parents with physical, cognitive, or mental-health disabilities.
Family courts, child welfare agencies, domestic-violence shelters, schools, medical providers, and mental-health professionals must be required to coordinate. When systems operate in isolation, abusers exploit the gaps and children suffer.
Judges and attorneys who knowingly enable false allegations, suppress evidence, deny due process, or abuse their authority must be investigated and held accountable. Abuse of power within the legal system must not be protected by professional status.
Family courts must prioritize child safety, truth, due process, and disability rights—not money, reputation, or legal strategy. Children and survivors deserve protection, not punishment.
