

America Is Broken: Reform the Family Court System to Protect Children and Survivors

America claims to value families, children, and justice. Yet for countless parents and children, the family court system does the opposite—it silences survivors, rewards abuse, and treats children as collateral damage.
Across the United States, family courts wield enormous power over the lives of families with little transparency or accountability. Survivors of domestic violence, parents with disabilities, and low-income caregivers are routinely discredited, punished, or pushed out of their children’s lives, while abusers exploit money, reputation, and legal loopholes to maintain control.
Documented abuse is often minimized or reframed as “high-conflict parenting.” Mental health crises—frequently caused by trauma and violence—are weaponized to permanently undermine a parent’s credibility. Parenting time becomes a bargaining chip instead of a child’s right to safety, stability, and love.
Children suffer the most.
They are separated from safe parents, exposed to coercive control, and taught that abuse is normal—while courts claim to act in their “best interests.”
This is not justice.
This is systemic failure.
What Must Change
We call on lawmakers, judicial oversight bodies, and civil rights agencies to take immediate action to:
• Create real oversight and accountability for family courts
• Guarantee legal representation for survivors of domestic violence and parents with disabilities
• Require trauma-informed and disability-competent training for judges and court staff
• Prevent misuse of ex parte and emergency custody orders
• Require coordination between family court, child welfare, and disability services
• Center children’s safety, stability, and emotional well-being in all custody decisions
Why This Matters
A nation cannot claim to value families while operating a system that rewards abuse, punishes vulnerability, and devastates children.
Reforming the family court system is not a political issue—it is a human rights issue.
