Open Letter to Consumers,
Please take the time to read you can assist in getting justice for a young man who will be starting his U.S. Air Force training in June he needs Help! He was cheated and the judge agreed. Merritt vs. AAMCO, Case Number 15G07337
This is a matter of AAMCO Transmission giving a verbal quote of $2,500 to rebuilt the transmission of my then 20-year-old sons 1997 Jaguar. There was no written estimate or work order created. After the repairs had started, Mr. Robert Bakhtiari, the Service Manager, informed us it would now cost $3,500. And if he chose not to pay the $3,500, they would put it back together for the cost $600.00. So under those circumstance we felt had no choice so agreed to the repair. Since November 25, 2014 my vehicle has had to return to AAMCO on eight different occasions. The vehicle had been in a non-drivable condition since August 29, 2015 waiting on original court date set for December 30, 2015. AAMCO had the date postponed until February 29, 2016. We went to court finally on that date and won using the Business and Professions Code Section 9884.9 and the case of BENNETT vs HAYES. AAMCO admitted in open court when ask by the judge if he had giving to me a written estimate before working on the Jaguar they answered “NO” thereby violating the law. That is when the court order Judgment is entered against Defendants AAMCO and HIS Automotive Repair, Inc., jointly and severally for failure to provide a written estimate of the cost of work on Plaintiff Tyrone Merritt Jr.'s vehicle in violation of The Business and Professions Code Section 9984.9 and for substandard work on Mr. Merritt's vehicle. The amount of the judgment is $3,830, reflecting the amount that Mr. Merritt paid Defendants for the work on his car ($3,500), plus the amount that Mr. Merritt paid a third party to diagnose the problems with the car after Defendant's' work was completed. Mr. Merritt also is awarded costs of $130.00.
By not giving to me a written estimate before working on my Jaguar AAMCO violated. Bennett v. Hayes, 53 Cal.App.3d 700 But instead of just paying the judgment AAMCO decided to appeal it after admitting the judge wrongdoing. This appeal is in bad faith, AAMCO has no grounds to appeal. They are just harassing him and holding on to my son money who has just enlisted in the U.S. Air Force. He is doing his best to prepare for graduation with his Bachelor of Science Degree in Criminal Justice and at the end of June starts his training to serve this nation proudly. Thank you for taking the time to read.
