Sadly, in the face of evidence of corruption, lies and coercion my appeal has been denied. The Army Court of Criminal Appeals refused to review Elliott Henney's sworn statement informing the US Army court system of lies and coercion, they refused to admit a total lack of any evidence or factual sufficiency in my case and continue to stomp on any Right to Due Process. In ten words, the US Court of Appeals for the Armed Forces turned its back on its solemn duty to ensure justice...they placed its "rubber stamp" on the cowardice bigoted actions of the Army...so the appeals process is over. We are now at the will of the Secretary of the Army to reject the dismissal portion of my sentence...literally a dismissal will "erase" me from ever have put on the uniform... 27 years of service, any retirement and any access to medical care will be gone... We are filing an Art 74 petition to the Secretary (there is NO confirmed Secretary at this time) so I have no idea who is authorized by Title X to decide my dismissal. My accuser roams free - he even gets a stipend as a "victim" equal to the real victims of real sexual assaults...that disgusts me to think that they have put that predator into the same definition as many of the real assault victims I have met during this ordeal...How many of them after reading and seeing the way my case was "used" and "misused" in this era of trying to get a reign on sexual assaults that do occur in our Armed Forces, but as almost all of them told me...they know there are people who lie and those liars get away with murder...they do more damage to the integrity of the system and the military then will ever be acknowledged. All of those brave women and men who are true victims told me that my case represents the "other-side" of the coin...Not only are real assaults not handled properly, but the Army and others can't handle false allegations either... Thank you all for putting your names and support behind my family and me. Please Remember the brave men and women in uniform everyday...Protect the innocent and Hold the Leaders accountable and responsible for the process to protect our warriors.
